These Terms of Service govern your use of www.essenceatelierhome.com and any purchases made through our online store.

Essence Atelier Home is an independent homeware brand based in Switzerland, operated by [Beatriz Bertomeu Gomez, Grand'Rue 14, 1172 Bougy-Villars, SWITZERLAND.

By accessing our website or placing an order, you agree to these Terms of Service. Please read them carefully before making a purchase.

1. OUR PRODUCTS

Essence Atelier Home creates small-batch and handmade objects for the home, including candles, decorative pieces and hand-cast homeware.

Many of our pieces are individually poured, cast, painted or finished by hand in our atelier in Switzerland.
 

Because of the handmade nature of our products, slight variations in colour, texture, pattern, surface and finish are to be expected. Small air bubbles, subtle markings, variations in marbling or differences between individual pieces may naturally occur during the making process. These characteristics are part of the piece and do not, by themselves, constitute a defect.

No two handmade pieces will be entirely identical.

We make every effort to represent our products accurately on our website. However, colours may appear slightly different depending on your screen, lighting conditions or device.

Product photographs may not always represent exact scale. Please refer to the dimensions and other information provided on each individual product page before ordering.

2. HANDMADE & NATURAL VARIATIONS

Our Jesmonite pieces are individually cast and finished by hand. Natural variations may include subtle changes in colour, marbling, texture, small air bubbles or minor surface irregularities.

Our candles are also individually poured and finished by hand. Slight variations in colour, finish, weight or appearance may occur between batches.

These differences reflect the way each piece is made and are part of the character of handmade production.

They are not considered faults unless they materially affect the intended use of the product.

3. PRODUCT CARE & SAFETY
 

Customers are responsible for following the care and safety instructions supplied with our products and available on our website.

Candles should never be left burning unattended and should always be kept away from children, pets, draughts and flammable materials.

Essence Atelier Home cannot be held responsible for damage caused by misuse, failure to follow care instructions, normal wear and tear or use of a product for a purpose for which it was not intended.

Nothing in these Terms excludes any liability that cannot legally be excluded under applicable consumer law.

4. PRICING

Prices are displayed on our website in the currency shown at checkout.

We reserve the right to change our prices at any time. Any price change will not affect an order that has already been accepted.

The price applicable to your purchase is the price displayed when your order is placed.

Shipping charges, where applicable, are calculated and shown before you complete your order.

For international orders, additional customs duties, import VAT or other local charges may apply depending on the destination country.

Unless expressly stated otherwise at checkout, these charges are not included in the product or shipping price and remain the responsibility of the customer.

5. ORDERS

When you place an order through our website, you will receive an order confirmation by email.

Please check your order details carefully, including the products ordered and your billing and delivery information.

It is the customer's responsibility to provide complete and accurate information when placing an order.

If you notice an error after placing your order, please contact us as soon as possible at hello@essenceatelierhome.com.

We reserve the right to decline or cancel an order where necessary, including in cases of:

• incorrect pricing or product information;

• suspected fraudulent activity;

• payment failure;

• stock or production errors; or

• circumstances that make fulfilment of the order impossible.

If we cancel an order after payment has been received, the amount paid for the cancelled items will be refunded.

6. PRODUCT AVAILABILITY

Many Essence Atelier Home pieces are handmade in small quantities.

Product availability may therefore be limited.

Adding an item to your basket does not reserve it. Products are only secured once the checkout process has been completed and payment has been successfully processed.

We reserve the right to discontinue products or change available colours, finishes or collections without prior notice.

7. PAYMENT

Payment must be made using one of the payment methods offered at checkout.

Orders will only be processed once payment has been successfully authorised.

All payment transactions are handled through the secure payment providers available through our website.

Essence Atelier Home does not directly store full credit or debit card information.

8. PROCESSING & SHIPPING

Orders are processed within 72 hours of order confirmation.

This processing period is separate from the estimated shipping or transit time displayed at checkout.

As many of our pieces are handmade and prepared in small quantities, processing may occasionally take longer during particularly busy periods, collection launches or exceptional circumstances.

If a significant delay affects your order, we will contact you using the email address provided at checkout.

Delivery times vary according to destination and shipping service and are estimates rather than guaranteed delivery dates unless expressly stated otherwise.

Essence Atelier Home currently ships within Switzerland and to selected international destinations, including countries within the European Union and the United Kingdom.

Once an order has been dispatched, customers will receive shipping information where tracking is available.

9. INTERNATIONAL ORDERS, CUSTOMS & IMPORT CHARGES

Orders shipped outside Switzerland may be subject to import VAT, customs duties, handling fees or other charges imposed by the destination country.

These charges are determined by local authorities and are outside the control of Essence Atelier Home.

Unless explicitly stated otherwise during checkout, the customer is responsible for any such charges.

Customers are responsible for checking applicable import requirements before placing an international order.

If an international parcel is refused because the customer does not wish to pay applicable import charges, any refund may be reduced by shipping, return shipping, customs or handling costs incurred by Essence Atelier Home, to the extent permitted by applicable law.

10. RETURNS

We hope that every Essence Atelier Home piece finds its place in your home. If you change your mind, you may request a return within 14 days of receiving your order.

Please include your order number and the item or items you wish to return.

Once your return request has been accepted, the products should be returned promptly in accordance with the return instructions provided.

Returned items must be:

• unused;

• in their original condition;

• free from damage, stains or signs of use; and

• safely packaged for return.

Where applicable, original packaging should also be returned.

Customers are responsible for the cost of returning unwanted items unless the product is faulty, damaged upon arrival or we have sent the incorrect item.

We recommend using a tracked shipping service, as the customer remains responsible for the returned parcel until it reaches us.

Nothing in this section limits any statutory consumer rights that apply in the customer's country of residence.

11. NON-RETURNABLE ITEMS

Certain products may not be eligible for a change-of-mind return where permitted by applicable law.

This may include products that have been made to the customer's specifications or clearly personalised.

Products that form part of our standard collection but are simply handmade are not considered personalised solely because they are handmade.

Any applicable return restriction will be clearly stated on the relevant product page before purchase.

This does not affect your rights where an item is faulty, damaged or incorrectly supplied.

12. REFUNDS

Once a returned product has been received and inspected, we will notify you regarding your refund.

Approved refunds will be issued to the original payment method.

Depending on your payment provider or bank, it may take additional time for the refunded amount to appear in your account.

Where required by applicable consumer law, standard outbound delivery charges will also be refunded.

Additional delivery charges resulting from the customer's choice of a premium or expedited shipping method may not be refundable beyond the cost of the standard delivery option, where permitted by law.

Customs duties, import taxes and fees paid directly to customs authorities or third parties cannot normally be refunded by Essence Atelier Home.

13. DAMAGED, FAULTY OR INCORRECT ITEMS

Please inspect your order shortly after delivery.

If an item arrives damaged, faulty or if you receive the wrong product, please contact us as soon as reasonably possible at:

Please include:

• your order number;

• a description of the issue; and

• photographs showing the product and, where relevant, the packaging.

We will assess the issue and provide an appropriate solution, which may include replacement, repair or refund depending on the circumstances and applicable consumer law.

Handmade variations described in Sections 1 and 2 are not considered faults unless they materially affect the function or quality of the product.

14. CANCELLING AN ORDER

If you wish to cancel or modify an order before it has been dispatched, contact us as soon as possible at hello@essenceatelierhome.com.

We will do our best to accommodate your request, but we cannot guarantee that an order can be changed or cancelled once processing has begun.

Your statutory cancellation and withdrawal rights, where applicable, remain unaffected.

15. INTELLECTUAL PROPERTY
 

All content appearing on the Essence Atelier Home website, including photographs, product designs, text, graphics, branding, logos and other original material, belongs to Essence Atelier Home or is used with appropriate permission.

Such content may not be copied, reproduced, distributed, modified, published or used for commercial purposes without prior written permission.

Purchasing a product does not transfer any intellectual property rights relating to its design, imagery or branding.

16. WEBSITE USE

You agree not to use this website for any unlawful purpose or in any way that could damage, interfere with or compromise the operation or security of the website.

We reserve the right to restrict access to the website where misuse, fraud or unlawful activity is reasonably suspected.

17. WEBSITE INFORMATION

We take reasonable care to ensure that information published on our website is accurate.

Occasionally, information may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, availability, shipping charges or other details.

Where an obvious error has occurred, we reserve the right to correct the information and, where necessary, contact customers whose orders may be affected.

18. LIABILITY

To the fullest extent permitted by applicable law, Essence Atelier Home will not be liable for indirect or consequential loss resulting from the use or misuse of our products or website.

We are not responsible for delays or failure to perform an obligation where this results from circumstances reasonably outside our control, including postal disruption, customs delays, natural events, transportation disruption or other force majeure circumstances.

Nothing in these Terms limits or excludes liability where doing so would be unlawful, nor does it affect mandatory consumer rights.

19. PRIVACY

Personal information submitted through our website is handled in accordance with our Privacy Policy.

By placing an order, you acknowledge that certain personal information is required for us and our service providers to process payment, fulfil your order and arrange delivery.

20. THIRD-PARTY SERVICES

Our website may use or contain links to third-party services, including payment providers, shipping providers and social media platforms.

We are not responsible for independent third-party websites or services, and their use may be subject to separate terms and privacy policies.

We may update these Terms of Service from time to time.

Any changes will be published on this page with an updated revision date.

The Terms applicable to an order are those in force at the time the order is placed.

22. GOVERNING LAW

These Terms are governed by Swiss law, subject to any mandatory consumer protection rights that apply to customers in their country of residence.

Nothing in these Terms is intended to deprive consumers of protections that cannot lawfully be excluded or restricted.

For consumer disputes, applicable mandatory rules regarding jurisdiction remain unaffected.
